Terms of Use

These terms are the agreement between you and [to be completed: operatorName], [to be completed: operatorAddress], registration number [to be completed: operatorRegistration] (“we”, “us”), for the use of the Roamly app and services. By creating an account you accept them. If you do not agree, do not use Roamly.

Nothing in these terms takes away rights you have as a consumer under the law of the country where you live.

1. Who can use Roamly

You must be at least 16 years old. By creating an account you confirm that you are. You must give a working e-mail address and keep your password to yourself; what happens under your account is your responsibility until you tell us it has been compromised. One person, one account. We may refuse or close accounts that break these terms.

2. What Roamly is

Roamly is a place where creators publish what they know about travel — posts about places, stories, trips — and readers follow them, save recommendations, message them, and can pay for members-only content, individual paid posts and trips, or an itinerary built from a creator’s recommendations with the help of an AI model. We provide the platform; the content comes from creators, and the opinions in it are theirs.

We may change or discontinue features. If a change substantially reduces what you have paid for, section 6 on refunds applies.

3. Your content

You own what you post. You give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example to make thumbnails, previews and notification snippets), display and distribute your content within the Roamly service and to promote the service, for as long as the content is on Roamly. The licence ends when you delete the content or your account, except for copies that remain in messages you sent (section 4) and for the time needed to remove it from backups.

You promise that you have the right to post what you post — your own photos and videos, or material you are allowed to use — and that it does not break the rules in section 5. You are responsible for your content; we are not obliged to review it before it appears, though we may.

Tagged places are identified through Google’s place database. A tag is a label you attach to a post, not a claim by us about the place.

4. Messages

Readers can message creators, and creators can reply; a creator can choose who may write to them (everyone, members, or nobody). Messages are not end-to-end encrypted and may be reviewed by authorised staff when a report, a safety concern, a support request or the law requires it. You can unsend a message you wrote; the other person may already have read it. When an account is deleted, the messages it sent stay in the other person’s inbox, attributed to “Deleted account”.

5. Community rules

Do not post, send or do any of the following on Roamly:

We may remove content, hide comments, limit features, suspend or close accounts that break these rules, and we may do so without warning when the breach is serious. Where the law requires, we will tell you what was removed and why, and you can appeal by writing to [to be completed: contactEmail] within 30 days; we will review the decision and reply. You can report content or people from within the app; we look at every report.

6. Buying things: memberships, paid posts and trips, itineraries

6.1 Prices and payment

Prices are shown in the app before you buy, including VAT where it applies. Purchases are made through the App Store (Apple) or Google Play (Google), under their payment terms. They charge you; we do not see your payment details.

6.2 What you get

Content is provided for your personal use. Do not copy, resell or redistribute paid content.

6.3 Right of withdrawal

If you are a consumer in the EU you normally have 14 days to withdraw from a distance purchase. For digital content that is delivered immediately — which is what you buy on Roamly — you agree, when you confirm the purchase, that delivery starts at once and that you thereby lose the right of withdrawal. This is what the store’s purchase screen asks you to accept.

6.4 Refunds

Refunds for App Store and Google Play purchases are handled by the store, under its rules; ask Apple or Google. Where a refund is granted, the corresponding access ends. If content you paid for is removed by us for breaking these terms, or if an itinerary cannot be generated, we will refund the purchase; write to [to be completed: contactEmail] if the refund does not reach you within a reasonable time.

6.5 Itineraries and AI

Itineraries are produced by an AI model from the creator’s posts and tagged places and from what you tell us about your trip. They are suggestions, not verified travel advice: places close, prices change, roads shut, and the model can be wrong. Check opening hours, safety and bookings before relying on an itinerary. The creator whose content is used receives a share of the price (section 7.3).

7. Creators

7.1 Becoming a creator

Anyone can apply from the app. We may approve, refuse or later revoke creator status. A verification badge means we have confirmed the account is who it says; it is not an endorsement.

7.2 Your obligations

Everything in section 5, and also: be clear when a post is a paid promotion or you received something for free; do not present other creators’ work as yours; keep your members-only content updated as you promised your members; and respond to messages in a reasonable time if you have chosen to accept them.

7.3 Money

You set prices for memberships, individual posts and trips, within the limits shown in the app. When something of yours is sold:

  1. The store (Apple or Google) takes its fee first — at the time of writing 15% or 30% of the price, depending on the store and the type of sale.
  2. From what remains, we keep a platform fee of 20%.
  3. The rest is your earning.

For an AI itinerary based on your content, your earning is 20% of the price after the cost of the AI model.

Earnings become available 30 days after the sale, to cover refunds. Refunded or reversed sales reduce your earnings, including from later payouts. You can request a payout once your available balance is at least €20; we pay by bank transfer to the details you give us, usually within 14 days, and one payout can be open at a time. The current rates are shown in the app; we may change them for future sales with at least 30 days’ notice.

You are responsible for the taxes on your earnings. We may ask you for the information needed to pay you lawfully (such as an invoice, VAT status or identification) and may hold a payout until we have it. Where the law requires us to withhold tax or report your earnings, we will.

7.4 Ending

You can stop being a creator, or delete your account, at any time. Existing members keep access until their paid period ends; pending earnings are paid out once available, provided they are above the minimum, and unpaid amounts below the minimum are paid on request.

8. Our content and trademarks

Roamly, its logo, design and software belong to us or our licensors. These terms give you a personal, non-transferable right to use the app as intended. Do not reverse-engineer it, extract its database, or remove notices.

9. Ending the agreement

You can end it at any time by deleting your account (Settings → Delete account). We can suspend or close your account if you breach these terms, if the law requires, or if we stop offering the service; we will give notice where reasonable and, where you have paid for something you can no longer use because of a decision of ours, refund it. Sections 3 (the licence for what remains), 10, 11 and 12 survive.

10. Disclaimers

Roamly is provided as it is. Travel content is the creators’ opinion and experience; we do not verify it. We do not guarantee that the service will be uninterrupted or error-free, that a creator will keep publishing, or that an itinerary is accurate. Nothing here limits warranties that consumer law does not allow us to limit.

11. Liability

We are liable without limit for damage caused intentionally or by gross negligence, for death or personal injury, and wherever the law does not allow liability to be limited. Otherwise, our liability to you is limited to foreseeable damage typical for this kind of service and, for paid services, to the amount you paid us in the twelve months before the event. We are not liable for content posted by creators or other users, or for services of third parties (the app stores, map providers) governed by their own terms.

12. Law and disputes

These terms are governed by the law of Romania. If you live in another EU country, you also keep the protection of the mandatory consumer rules of that country. Disputes can be brought before the courts of Romania or, if you are a consumer, of the country where you live. Before going to court, write to us; most problems are solved by a conversation. Consumers in Romania can also contact the National Authority for Consumer Protection (ANPC, anpc.ro) or an alternative dispute resolution body listed there.

13. Changes to these terms

We may update these terms. For changes that matter we will tell you in the app or by e-mail at least 30 days before they take effect, and ask you to accept them; if you do not, you can delete your account before they apply. Using Roamly after the effective date means you accept the new terms. The current version is always at https://roamly-legal.pages.dev/terms/.
